(SAGAR – Security and Growth for All in the Region)

(Way Forward)

Geopolitical Consolidation in the Western Indian Ocean: The Strategic Matrix of India-Seychelles Bilateral Outcomes

Prime Minister Narendra Modi’s state visit to the Seychelles marks a milestone in India’s maritime diplomacy and geopolitical consolidation within the Western Indian Ocean (WIO). Against a backdrop of increasing geostrategic competition, climate vulnerabilities, and changing security dynamics in international shipping lanes, the delegation-level engagements in Victoria demonstrate India’s commitment to translating its peripheral vision into structural partnerships. By unveiling a comprehensive matrix of 19 distinct bilateral outcomes spanning maritime security, space technologies, healthcare, agriculture, and cross-border digital payment infrastructure, India has reinforced its position as a preferred security partner and net security provider in the region.

For civil services aspirants, analyzing this bilateral framework provides insights into the operationalization of India’s SAGAR (Security and Growth for All in the Region) doctrine and its broader coordination with the Global South. The engagement with small island developing states (SIDS) like the Seychelles is no longer an auxiliary element of Indian foreign policy; it is a primary theater for implementing multilateral strategy, balancing naval footprints, and building resilient economic networks.

This article provides an in-depth geopolitical and administrative analysis of the newly established India-Seychelles strategic commitments, engineered to meet the requirements of both the UPSC and SSC examinations.

Background and Context

The official engagement took place during a three-day state visit by Prime Minister Narendra Modi to the archipelagic nation, where he met with Seychelles President Patrick Herminie and addressed the country’s National Assembly. The timing aligns with the golden jubilee celebrations of the Seychelles’ national independence, emphasizing the deep historical ties between the two democracies. The core legislative and diplomatic focus of the bilateral summit centered on sharing administrative responsibilities to maintain the stability, security, and sustainability of the Indian Ocean as a shared home.

Five Important Key Points

  • India and the Seychelles officially signed and unveiled 19 bilateral outcomes, expanding cooperation into advanced areas like space technologies, digital payments, and healthcare.
  • To strengthen regional maritime surveillance, India gifted a fast patrol vessel, five Laser Radial class boats, and 10 utility vehicles to the Seychelles Defence Force.
  • The Indian Navy and Coast Guard completed a major technological refit of the patrol ship PS Zoroaster and upgraded a Seychelles Dornier aircraft with an advanced glass cockpit.
  • In recognition of India’s leadership in the blue economy, Prime Minister Modi was conferred with the prestigious “Guardian of the Blue Horizon” honor by the Seychelles President.
  • An Indian Army marching contingent consisting of 32 personnel from the Assam Regiment participated directly in the Seychelles’ 50th National Day ceremonial parade.

The Architecture of the 19 Bilateral Outcomes

The 19 agreements negotiated during the summit establish a multi-layered functional framework designed to systematically integrate the technical capabilities of both nations:

  • Digital Infrastructure Integration: The implementation of a framework to advance Unified Payments Interface (UPI)-based digital transactions within the Seychelles lowers transaction costs for tourism and deepens economic links.
  • Space and Outer Space Cooperation: A formal bilateral agreement for cooperation in the peaceful uses of outer space enables real-time data sharing, remote sensing, and satellite-based monitoring of the Seychelles’ vast Exclusive Economic Zone (EEZ).
  • Financial and Credit Lines: The signing of an umbrella line of credit agreement with the Export-Import Bank of India (EXIM Bank) creates institutional pathways for sustainable infrastructure project financing.
  • Administrative and Legal Frameworks: The formalization of an extradition treaty institutionalizes judicial and counter-terrorism cooperation, bridging enforcement gaps between the two nations.

Operationalizing the SAGAR Doctrine and Maritime Security

The physical delivery of defense assets—including a fast patrol vessel, five Laser Radial class boats, and the structural upgrades performed on the PS Zoroaster and the Dornier surveillance aircraft—serves as a practical demonstration of India’s SAGAR doctrine.

India-Seychelles Defense Delivery Matrix:
+---------------------------+-----------------------------------+
| Asset Delivered/Upgraded | Operational Target Area |
+---------------------------+-----------------------------------+
| Fast Patrol Vessel | Anti-Piracy & Counter-Smuggling |
| 5 Laser Radial Boats | Tactical Coastal Patrols |
| Dornier Glass Cockpit | Long-Range Airborne EEZ Scanning |
| PS Zoroaster Refit | Persistent Blue-Water Operations |
+---------------------------+-----------------------------------+

By enhancing the organic enforcement capabilities of the Seychelles Coast Guard, India helps mitigate asymmetric threats such as illegal, unreported, and unregulated (IUU) fishing, narcotics trafficking, and maritime piracy without resorting to heavy-handed base securitization.

Climate Justice and Advocacy for the Global South

Addressing the National Assembly of the Seychelles, the Indian Prime Minister raised critical arguments regarding global climate equity, noting that Small Island Developing States (SIDS) experience disproportionately high impacts from climate change despite contributing minimally to historical global emissions. By stating that climate action must be guided by fairness, responsibility, and equity, India reinforced its role as an institutional voice for the Global South. This diplomatic alignment strengthens India’s position within multilateral forums like the United Nations Framework Convention on Climate Change (UNFCCC) and the India-led Coalition for Disaster Resilient Infrastructure (CDRI).

Geostrategic Equilibrium and Countering Encirclement

The Western Indian Ocean is a key choke point for international energy corridors and commercial shipping channels. In recent years, extra-regional powers—most notably China through its maritime silk road initiative and string of pearls strategy—have continuously sought to build operational bases in the region.

India’s cooperative strategy, which prioritizes mutual respect, trust, and capacity building rather than asymmetric debt models, offers a sustainable alternative for island nations. By securing deep institutional partnerships with the Seychelles, Mauritius, and the Maldives, India preserves a balanced maritime balance of power and prevents unilateral dominance over shared oceanic commons.

The Bihar Connection: Human Capital and Global Remittance Networks

While maritime defense pacts are primarily implemented along the coastal periphery, their underlying socioeconomic impacts extend to inland human capital hubs like Bihar. Over the past decade, the state of Bihar has experienced an outward shift of skilled and semi-skilled technical professionals, teachers, IT personnel, and healthcare workers moving to island nations and East African hubs via specialized recruitment pathways.

The institutionalization of cross-border digital payment networks like UPI and the formalization of extradition and legal treaties provide direct structural security to Bihari expatriates working in the Western Indian Ocean region. Furthermore, by lowering transactional barriers for international financial flows, the agreement directly supports the stability of global remittance channels, which play a vital role in Bihar’s rural economy.

Way Forward

To sustain the diplomatic gains from the Victoria summit and ensure the successful long-term implementation of the 19 outcomes, India should consider the following actions:

  • Accelerate Project Delivery: Ensure time-bound implementation of infrastructure works funded via the EXIM Bank line of credit to demonstrate institutional reliability.
  • Establish a Joint Maritime Security Center: Set up a permanent information-fusion center in Victoria to process real-time remote-sensing and data streams generated by the upgraded Dornier aircraft and satellite assets.
  • Expand Blue Economy Fellowships: Create dedicated academic and research allocations for Seychellois scholars within premier Indian oceanography and marine biology institutes.
  • Institutionalize Regular Joint Patrols: Expand the scale of bilateral naval exercises and coordinated EEZ patrols between the Indian Navy and the Seychelles Coast Guard to ensure operational readiness against non-traditional maritime threats.

(Way Forward)

The United Kingdom-India Comprehensive Economic and Trade Agreement: A Paradigm Shift in Post-Brexit Bilateral Commerce

The formal enforcement of the Comprehensive Economic and Trade Agreement (CETA), widely designated as the United Kingdom-India Free Trade Agreement (FTA), marks a historic juncture in modern trade diplomacy. As India rapidly progresses on its trajectory to become the world’s third-largest economy within the next five years, and the United Kingdom consolidates its post-Brexit global trade footprint, this pact transitions bilateral relations from abstract diplomatic rhetoric into a highly institutionalized economic partnership. In an era characterized by geoeconomic fragmentation and the restructuring of global value chains, this comprehensive trade agreement offers an analytical template for modern, balanced, and value-driven trade negotiations between advanced and developing economies.

For civil services aspirants, the analysis of the UK-India CETA is essential for understanding the dynamics of international trade architecture, tariff liberalizations, rules of origin, and the integration of non-tariff modern trade values such as gender and sustainable development. This agreement redefines the traditional boundaries of free trade pacts by balancing extensive market access with strategic domestic commercial protections. It provides a key case study for competitive examinations evaluating India’s foreign trade policy and global economic standing.

Background and Context

The long-awaited trade agreement represents nearly three years of intense, multi-round bilateral negotiations aimed at optimizing market access and removing deep-seated regulatory barriers. Entering into force formally on July 15, the agreement arrives at a time when bilateral trade between the two nations had already crossed a baseline of £48 billion annually. The economic mechanics of this treaty are engineered to drastically lower transaction costs, simplify customs enforcement protocols, and generate an institutional framework conducive to sustained technology transfer and long-term capital flows.

Five Important Key Points

  • The United Kingdom-India Comprehensive Economic and Trade Agreement (CETA) officially enters into force on July 15, establishing a new legal architecture for bilateral trade.
  • Under the agreement, the United Kingdom provides immediate tariff-free access to 99% of its import lines for Indian products, benefiting labor-intensive manufacturing sectors.
  • India eliminates or substantially reduces import tariffs across 90% of its tariff lines, lowering operational costs for critical British industrial exports.
  • Long-term economic projections indicate that the agreement will expand bilateral trade by £25.5 billion annually, boosting Indian GDP by £5.1 billion and UK GDP by £4.8 billion.
  • For the first time in India’s major trade pact history, the agreement includes dedicated, value-oriented standalone chapters on anti-corruption, gender integration, and labor-environmental standards.

Macroeconomic Implications and Growth Forecasts

The economic models underpinning the UK-India CETA demonstrate a complementary structural relationship between the two economies. For India, preferential access to the UK market acts as a catalyst for high-volume exports in employment-generating sectors like textiles, leather manufacturing, and gems and jewelry. This directly advances the objectives of the ‘Make in India’ initiative by providing stable, high-value consumer markets. Conversely, British exporters will see immediate tariff relief estimated to fall by approximately £400 million in the initial phase, scaling up to a projected £900 million in subsequent phases as phased tariff reductions mature.

Bilateral Trade Impact Metrics (Long-Term Projected Annual Increase):
+--------------------+---------------------+--------------------+
| Indian GDP Boost | UK GDP Boost | Bilateral Trade |
+--------------------+---------------------+--------------------+
| +£5.1 Billion | +£4.8 Billion | +£25.5 Billion |
+--------------------+---------------------+--------------------+

Sectoral Dynamics: Services and High-Value Industries

Beyond traditional merchandise trade liberalizations, the real economic core of this agreement lies in services and high-value technical industries:

  • Information Technology and Financial Services: The agreement locks in regulatory predictability and removes non-tariff barriers, enabling Indian IT service providers and financial institutions to seamlessly scale operations within London’s financial ecosystem.
  • Critical British Industries: Sectors such as aerospace engineering, automotive components, medical device manufacturing, and Scotch whisky Scotch producers stand to experience substantial growth through optimized regulatory alignment and reduced border delays.
  • Small and Medium Enterprises (SMEs): Recognizing that administrative costs disproportionately burden smaller firms, the treaty simplifies customs clearance protocols and reduces red tape, allowing small-scale innovators to access global supply chains.

The Strategic Value Layer: Governance, Gender, and Environment

A major structural evolution in this treaty is the inclusion of standalone value chapters that reflect modern societal and governance priorities. By institutionalizing commitments to anti-corruption, gender equity in commercial opportunities, and high labor and environmental sustainability standards, both nations have elevated CETA to a ‘gold standard’ for modern global trade agreements. This framework demonstrates that trade liberalization can align with social progress, environmental conservation, and clean governance protocols.

Strategic Defensive Safeguards and Protection Harmonization

A primary hurdle in any comprehensive trade negotiation is protecting sensitive domestic sectors from sudden import surges. The UK-India agreement handles this challenge through carefully calibrated exclusions:

  • Indian Defenses: India successfully maintained structural protections for its sensitive agricultural and dairy sectors, shielding millions of smallholder farmers and domestic edible oil producers from predatory external competition.
  • United Kingdom Defenses: On the reciprocal side, the UK government retained defensive walls around highly protected domestic commodities, including sugar, milled rice, pork, chicken, and eggs.

The Bihar Connection: Decongesting Growth Beyond Metros

While major trade agreements are historically viewed as corporate wins for metropolitan hubs like Mumbai or London, the UK-India CETA explicitly introduces provisions aimed at decentralizing trade benefits. For a developing economy like Bihar, which possesses a massive agrarian workforce and an emerging food processing sector, the reduction of non-tariff barriers and simplified rules of origin provide a vital avenue for structural transformation.

Artisanal clusters, agricultural producers, and specialized leather weavers in regions like Champaran, Nalanda, and Muzaffarpur can now integrate into international value chains via intermediary export syndicates. By removing administrative red tape, decentralized manufacturing units in Bihar can bypass standard domestic market saturation and supply specialized products directly to European distributors at highly competitive rates.

Way Forward

To maximize the economic yields of this historic trade deal and convert preferential tariff lines into tangible national wealth, India must pursue the following structural actions:

  • Targeted Export Promotion Councils: Establish state-level export enablement cells, particularly in lower-income states like Bihar, to train local MSMEs on complying with UK product and sanitary standards.
  • Supply Chain Mapping: Indian industries must immediately map their supply chains against the new rules of origin to gain first-mover advantages before international competitors occupy market shares.
  • Institutionalizing Digital Trade Frameworks: Accelerate the cross-border interoperability of digital trade documents to reduce physical verification times at maritime ports and cargo airports.
  • Strategic Monitoring System: Create a joint institutional tracking cell under the Ministry of Commerce to systematically monitor trade flows, assess non-tariff bottlenecks, and proactively trigger bilateral dispute resolution protocols when required.

(Material embodiment of the pious purpose)

(Way Forward)

The Jurisprudential Evolution of Deity as a Juristic Person and Governance of Religious Endowments

The recent investigative actions regarding the alleged misappropriation of donations at the Ram Temple in Ayodhya have brought profound constitutional, civil, and legal questions to the legal forefront. At the heart of this legal dispute is not merely an administrative or criminal inquiry into financial anomalies, but the fundamental legal architecture governing religious institutions in India. This case brings into sharp relief the sophisticated judicial doctrine that recognizes a Hindu deity as a “juristic person” under civil law—a legal fiction that treats the consecrated idol as a minor requiring human stewardship.

For civil services aspirants, understanding this unique intersection of legal theory, property laws, and institutional accountability is essential. Indian jurisprudence uniquely blends ancient religious customs with modern statutory frameworks, ensuring that religious endowments are subject to the rule of law while preserving their sacred autonomy. The legal status of a deity shapes property ownership, taxation, and state regulatory oversight, making it a recurring and critical theme in public administration and constitutional law.

This analytical article delves into the historical evolution, judicial precedents, constitutional provisions, and modern administrative challenges concerning the governance of religious endowments in India, providing a comprehensive framework for both UPSC and SSC examinations.

Background and Context

The current controversy centers on allegations of financial irregularities concerning cash and valuables donated by devotees as expressions of piety at the Ram Mandir in Ayodhya. In response to these developments, institutional changes have occurred within the Shri Ram Janmabhoomi Teerth Kshetra Trust, highlighting the critical responsibility of human agencies tasked with managing sacred property. The legal baseline of this entire dispute rests on the fact that the property and funds belong strictly to the deity itself, who holds the status of a legal unit of assessment and ownership under Indian law.

Five Important Key Points

  • The Indian legal system recognizes a consecrated Hindu deity as a juristic person with the capacity to hold property, sue, and be sued, while placing it in the legal position of a minor.
  • The physical possession and administrative management of a deity’s property vest in a human manager, traditionally known as a Shebait or Mahant, who holds the status of a mere trustee and not an owner.
  • In the landmark 2020 Sree Padmanabhaswamy Temple case, the Supreme Court reaffirmed that all public donations belong strictly to the deity and outlined the perpetual nature of Shebaitship rights.
  • The judicial precedent establishing the deity as a juristic entity dates back to historical rulings, including the Privy Council’s 1921 judgment in Vidya Varuthi Thirtha Swamigal v. Balusami Ayyar.
  • Under statutory frameworks like the Income Tax Act, a Hindu deity is recognized as an “individual” unit of assessment, reflecting its distinct legal personality independent of its managers.

Judicial Evolution and the Concept of Juristic Personality

The concept of a juristic person extends legal rights and duties to non-human entities. In continental and Anglo-Saxon jurisprudence, corporations, states, and ships are frequently granted legal personhood. Indian courts uniquely extended this concept to consecrated idols to protect the pious intentions of donors and establish clear property title.

In Angurbala Mullick v. Debabrata Mullick (1951), the Supreme Court clarified that in a Hindu religious endowment, the entire ownership of the dedicated property is transferred to the deity or the institution itself. The physical controllers do not acquire personal rights over the property; they are bound by fiduciary duties to act solely in the best interest of the deity. The Supreme Court’s Constitution Bench in the Ram Janmabhoomi case described the idol as the “material embodiment of the testator’s pious purpose,” emphasizing that the law protects the purpose behind the dedication.

Constitutional Framework and State Regulation

The governance of religious endowments exists within a complex constitutional framework balancing state oversight with religious freedom:

  • Article 25: Guarantees freedom of conscience and the right to freely profess, practice, and propagate religion, subject to public order, morality, and health.
  • Article 26: Grants religious denominations the right to establish and maintain institutions, manage their own affairs in matters of religion, and own, acquire, and administer property in accordance with law.
  • Article 110/246 (Concurrent List, Entry 28): Places charities and charitable institutions, charitable and religious endowments, and religious institutions under the joint legislative domain of both the Union and the States.

This concurrent jurisdiction has led various states to enact specific Hindu Religious and Charitable Endowments (HR&CE) Acts, setting up state-managed boards to oversee temple administration and prevent financial mismanagement.

Governance Concerns and Fiduciary Responsibilities

The legal characterization of a deity as a minor places significant responsibility on the human agencies managing temple affairs. In Bishwanath v. Sri Thakur Radhaballabhji (1967), the Supreme Court noted that if the designated managers act against the idol’s interests, any person interested in the worship can act as an ad hoc representative to protect the deity’s assets.

This mechanism is crucial when dealing with modern, multi-crore public donations. The lack of standardized, transparent digital accounting, independent audits, and institutional insulation frequently creates systemic vulnerabilities in public trusts. When administrative checks fail, public faith can suffer collateral damage, highlighting the need for robust institutional governance.

Comparative Global Analysis

While India uses the juristic person framework for deities, other global jurisdictions have granted legal personhood to natural and religious entities to ensure environmental or cultural protection:

  • New Zealand: The Whanganui River was granted legal personhood in 2017, allowing it to sue and be sued through designated human guardians representing its ecological and indigenous interests.
  • Ecuador and Bolivia: Rights of Nature (Pachamama) are constitutionally recognized, treating ecosystems as legal entities with the right to exist and persist.
  • Western Ecclesiastical Law: In canonical law, the parish church or the bishopric often exists as a corporation sole, separating personal assets from institutional property.

Implementation Challenges in Temple Administration

  • Autonomy vs. State Control: Constant litigation exists regarding the extent of state interference via HR&CE departments, with critics arguing that state control should be limited to preventing financial mismanagement without infringing on religious rituals.
  • Lack of Uniformity: Temple management varies across states, leading to regulatory fragmentation and unequal standards of financial transparency.
  • Encroachment of Land Assets: Deities across India own lakhs of acres of land, but weak land record digitization and poor monitoring leave these assets highly vulnerable to illegal encroachments and fraudulent sales by local actors.

Way Forward

To strengthen the administrative framework governing religious endowments and protect the assets of juristic deities, India should consider a multi-pronged reform strategy:

  • Standardized Digital Accounting: Implement mandatory, blockchain-backed digital accounting platforms for all public religious trusts to ensure real-time tracking of public donations.
  • Independent Audits: Mandate annual financial audits by independent panels approved by the Comptroller and Auditor General (CAG) to minimize institutional corruption.
  • National Registry of Religious Properties: Launch a centralized, geographic information system (GIS)-mapped database of all land assets held by juristic deities to prevent fraudulent transactions and illegal encroachments.
  • Professionalization of Management: Establish independent, professional administrative cadres for large public trusts, separating spiritual leadership from financial and logistics management.

Bihar’s Special Intensive Revision of Electoral Rolls: Democracy, Exclusion, and Constitutional Safeguards

The Special Intensive Revision (SIR) of electoral rolls, which commenced as a pilot exercise in Bihar on June 24, 2025, has now completed one year and expanded to 19 States and Union Territories across India. Bihar, as the State where the SIR was first implemented ahead of its Assembly elections, occupies a central position in what has become the most contested electoral process reform in India since the introduction of Electronic Voting Machines. Nearly six crore names have been deleted from electoral rolls across the country during the first year of SIR, with Bihar alone seeing approximately 65 lakh voters pruned from its rolls.

The SIR has generated fierce political controversy. Opposition parties — particularly the Samajwadi Party, the Indian National Congress, and the Trinamool Congress — have alleged that the Election Commission of India (ECI) is conducting the SIR in a manner that disproportionately removes Dalit, minority, and economically weaker voters from the rolls, effectively serving as a disenfranchisement tool. The Supreme Court, in March 2026, unanimously upheld the constitutional validity of the ECI’s decision to conduct the SIR. The SIR has now been incorporated into the NCERT’s Social Science textbook, which describes it as ensuring ‘no eligible citizen is left out and no ineligible person is included in the electoral roll’. West Bengal and Bihar governments have linked voter roll purification data to social security benefits, excluding individuals deleted during SIR from State welfare schemes — a development that has raised additional constitutional concerns.

For UPSC aspirants, the SIR is directly relevant to GS-II (Polity: Electoral Process, Election Commission of India, Representation of the People Act, constitutional provisions governing elections) and Current Affairs.

Background: Electoral Roll Revision and the SIR Framework

Five Important Key Points

  • The SIR commenced as a pilot in Bihar on June 24, 2025, ahead of its Assembly elections; Bihar’s electoral roll was subsequently pruned by approximately 65 lakh voters, reducing the State’s voter base significantly.
  • Across 19 States and Union Territories in the second phase (UP, West Bengal, Tamil Nadu, Rajasthan, Chhattisgarh, Kerala, and others), the combined voters’ list was pruned from 50.99 crore to 45.81 crore — a reduction of over 5.18 crore.
  • The Supreme Court unanimously upheld the constitutional validity of the ECI’s SIR exercise in March 2026, rejecting petitions that challenged it as a violation of the fundamental right to vote.
  • Bihar and West Bengal governments have linked voter roll purification data to social security benefits, making deletion from the electoral roll a potential trigger for exclusion from State welfare schemes — a policy with significant constitutional implications under Article 21.
  • The SIR has been incorporated into NCERT’s Social Science curriculum, reflecting the government’s effort to mainstream the exercise as a civic normalcy rather than a contested political process.

Historical and Legal Background

Electoral roll revision in India is governed by the Representation of the People Act, 1950 (which deals with the preparation and revision of electoral rolls) and the Registration of Electors Rules, 1960. The Election Commission of India, under Article 324 of the Constitution, has superintendence, direction, and control of the preparation, maintenance, and revision of electoral rolls and the conduct of elections. The ECI conducts four types of roll revision: continuous, intensive, special intensive, and summary revision. A Special Intensive Revision involves house-to-house survey, re-enumeration of eligible voters, and deletion of names of deceased, those who have migrated, or those who are otherwise ineligible.

The SIR’s context includes the citizenship controversy that has surrounded the National Register of Citizens (NRC) process in Assam and the broader debates about the National Population Register (NPR). Critics have drawn parallels between the SIR’s roll-purification methodology and Assam’s NRC process, arguing that both place the burden of proving citizenship/eligibility on individuals, potentially excluding genuine voters who lack documentation.

Bihar-Specific Analysis

Bihar’s experience as the SIR’s pilot State is foundational for understanding the exercise’s operational and political dynamics. The State’s 65 lakh voter deletion — representing approximately 9 percent of its voter base — was the largest absolute reduction in any State. The deletions were concentrated in urban areas (where migration is higher) and in districts with significant Muslim populations — particularly Seemanchal (Araria, Purnia, Kishanganj, Katihar) — leading to allegations that the process was being used for discriminatory targeting.

Bihar’s political context amplifies these concerns. The State has a fragile coalition government (NDA), with JD(U) under Chief Minister Nitish Kumar maintaining a delicate balance between the BJP’s Hindutva-inflected electoral strategy and the State’s socially diverse electorate. The SIR, in Bihar’s political landscape, intersects with caste identity, Muslim representation, and the rivalry between the NDA and the Tejashwi Yadav-led Mahagathbandhan (Grand Alliance) which represents backward and minority communities.

The linkage of voter deletion to social security benefits is particularly significant in Bihar. Bihar has some of India’s highest rates of poverty and dependence on government welfare — MGNREGA, PM Awas Yojana, PM Kisan, ration cards, and state pensions. Removing individuals from welfare eligibility based on electoral roll deletion effectively converts electoral disenfranchisement into social exclusion — a compounding form of marginalisation that disproportionately affects Bihar’s most vulnerable communities.

Constitutional Provisions and Supreme Court Judgment

The constitutional framework for electoral rolls is provided by Article 326 (adult suffrage), Article 325 (no voter ineligible on grounds of religion, race, caste, or sex), and Article 324 (ECI’s superintendence over elections). The Representation of the People Act, 1950, Section 15 mandates the preparation of electoral rolls for every constituency, with Section 22-23 dealing with revision and claim/objection processes.

The Supreme Court’s March 2026 judgment upholding the SIR’s constitutional validity relied on the ECI’s constitutional mandate under Article 324 to maintain clean electoral rolls. The Court held that the SIR’s objective — ensuring no eligible citizen is left out and no ineligible person is included — serves the constitutional purpose of free and fair elections. However, the Court did not specifically rule on the due process concerns raised by petitioners regarding the speed of deletions and the adequacy of notice periods given to voters whose names were proposed for deletion.

NCERT and Mainstreaming of SIR

The inclusion of SIR in NCERT’s Social Science textbook is a significant development that deserves scrutiny. Textbooks shape civic consciousness and inform how future generations understand democratic processes. The description of SIR as an exercise to ‘ensure no eligible citizen is left out and no ineligible person is included’ presents the exercise in its most benign form, without acknowledging the contested political and procedural questions it has raised. Critical pedagogy would require students to understand the arguments both for and against the SIR’s methodology, the Supreme Court’s nuanced judgment, and the ongoing debates about due process and minority representation.

Way Forward

Electoral roll accuracy is a genuine democratic necessity — rolls bloated with phantom voters or depleted by systematic exclusion both undermine electoral integrity. A reformed SIR framework should incorporate the following safeguards: First, the notice period for proposed deletions should be extended to at least 45 days (from the current 30 days), with notices issued in local languages and through multiple channels (SMS, gram panchayat announcements, school networks). Second, re-inclusion mechanisms should be simple and accessible, allowing deleted voters to restore their names with minimal documentation burden. Third, the linkage of voter roll deletions to social welfare eligibility should be severed — electoral roll status and welfare eligibility are separate legal matters and should not be conflated. Fourth, the ECI should publish ward-wise and demographic category-wise data on deletions, ensuring transparency that allows civil society to monitor for discriminatory patterns. Fifth, a permanent mechanism for continuous roll updation — using the Aadhaar-voter ID linkage, with appropriate privacy protections — should be developed to replace the periodic intensive revision model.

National Food Security Act Amendment 2026: Reforming Entitlements for India’s Most Vulnerable

The Union Food and Public Distribution Department’s release of draft amendments to the National Food Security Act (NFSA), 2013, on June 25, 2026, with a public comment period until July 13, has ignited a significant policy debate about the nature of food entitlements for India’s poorest citizens. The proposed amendment to Section 3 of the NFSA seeks to shift the Antyodaya Anna Yojana (AAY) — the programme for the ‘poorest of the poor’ — from a household-based allocation of 35 kg per household to a per-person entitlement of 7 kg per month, with a household maximum of 35 kg. The government’s stated rationale is to correct ‘intra-category inequities’ that currently disadvantage larger families, who receive a lower per-capita allocation than smaller ones.

The amendment has immediately attracted significant opposition. Non-BJP ruled States, including Kerala, and activists of the Right to Food Campaign have voiced sharp concerns. Kerala’s Food Minister Anoop Jacob has stated that the State will write to the Centre opposing the change. The Right to Food Campaign’s office-bearer Anuradha Talwar has characterised the amendment as creating a ‘North-South divide’ in foodgrain allocation: Southern States with smaller average family sizes would receive reduced total allocations, effectively penalising demographic achievement.

For UPSC aspirants, this amendment is highly relevant for GS-II (Government Schemes, Social Justice, Welfare Policy), GS-III (Food Security, Agriculture, Indian Economy), and potentially GS-IV (Ethics of welfare policy, distributive justice).

Background: National Food Security Act, 2013

Five Important Key Points

  • The NFSA, 2013, covers approximately 81.35 crore persons (67 percent of population), entitling Priority Household (PHH) members to 5 kg per person per month and Antyodaya Anna Yojana (AAY) households to 35 kg per household per month at highly subsidised rates — ₹3/kg for rice, ₹2/kg for wheat, ₹1/kg for coarse grains.
  • The proposed amendment changes AAY allocation from a fixed 35 kg per household to 7 kg per person per month (maximum 35 kg per household), intended to address inequity between small and large families under the AAY category.
  • Kerala and other Southern States argue the amendment would reduce their aggregate allocation because their smaller average household sizes mean 7 kg per person × 4 members = 28 kg, down from 35 kg — a 20 percent reduction for average-sized Southern families.
  • The Right to Food Campaign has been demanding 14 kg per person per month for AAY cardholders — double the proposed 7 kg — and has called for inclusion of pulses and edible oil in the food security basket to meet ICMR nutritional recommendations.
  • The Census delay (2021 Census not yet completed as of 2026) means AAY beneficiary lists have not been updated for population growth; activists argue that the amendment effectively reduces allocation without addressing the exclusion of eligible poor from AAY coverage.

Historical Background of Food Security Legislation

India’s food security architecture has evolved over decades. The Public Distribution System (PDS) dates to World War II, when the government rationed essential commodities to prevent wartime food crises. Post-independence, the PDS was institutionalised through the Essential Commodities Act, 1955, and expanded through the Targeted PDS system introduced in 1997, which created the Above Poverty Line (APL) and Below Poverty Line (BPL) categories. The Antyodaya Anna Yojana was launched in December 2000 by the Atal Bihari Vajpayee government, targeting the ‘poorest of the poor’ — estimated at 1 crore families — with 25 kg of food grain per month at steeply subsidised prices (later increased to 35 kg).

The National Food Security Act, 2013 — passed during the UPA-II government — was a landmark legislation that converted food entitlements into legal rights. For the first time, beneficiaries could approach courts for redress if denied entitled food grain. The Act also created the post of State Food Security Commissioners and Vigilance Committees at district and block levels to monitor implementation.

Constitutional and Legal Framework

The right to food has been progressively recognised by the Supreme Court as part of the fundamental right to life under Article 21 of the Constitution. The landmark PUCL v. Union of India case (2001) resulted in the Supreme Court’s interim orders directing States to operationalise welfare schemes as legal entitlements rather than discretionary benefits. The Court’s subsequent orders — particularly in 2002-03 — created the framework of entitlements that eventually became the NFSA’s statutory basis.

The NFSA amendment must be evaluated against this constitutional backdrop. If the amendment results in reduced food grain access for large families that are currently AAY beneficiaries, it could potentially be challenged as violating Article 21. The government’s counter-argument is that the per-person approach is more equitable and nutritionally rational, ensuring that each individual receives a guaranteed minimum rather than having larger households dilute a fixed household entitlement.

Economic and Fiscal Implications

The food subsidy bill has been a major fiscal challenge. In FY 2024-25, India’s food subsidy was approximately ₹2.05 lakh crore — one of the largest expenditure items in the Union budget. The NFSA 2013, by creating legal entitlements, made it politically and legally difficult to reduce the subsidy bill. The amendment’s fiscal neutrality is a stated government objective: by linking allocation to household size, the government aims to ensure that food subsidy flows are better targeted without necessarily reducing the overall quantum of subsidy.

However, the Right to Food Campaign’s demand for 14 kg per person per month would have the opposite fiscal effect — significantly increasing the subsidy bill. Activists argue that given India’s malnutrition indicators (NFHS-5 data shows that 35.5 percent of children under 5 are stunted and 32.1 percent are underweight), the current 5 kg per person per month for PHH and 7 kg proposed for AAY are nutritionally inadequate.

North-South Divide and Federalism

The most politically charged aspect of the amendment is its differential impact across States. Southern States — Kerala, Tamil Nadu, Karnataka, and Andhra Pradesh — have successfully undergone demographic transition, with average household sizes of 3.5 to 4.5 members. Northern States — Bihar, Uttar Pradesh, Rajasthan, and Madhya Pradesh — continue to have larger average household sizes of 5 to 6 members. Under the proposed amendment, Southern families with 3-4 members would receive 21-28 kg under the new formula, compared to 35 kg under the current household-based scheme. Northern families with 5-6 members would actually receive 35-42 kg — potentially more than the current cap of 35 kg. This creates a situation where demographic achievement is effectively penalised.

Bihar Connection

Bihar is one of the States where the NFSA amendment could have the most significant positive impact — or at least the least negative impact. Bihar has one of India’s largest average household sizes (5-6 members), meaning AAY families in Bihar would receive 35 kg or more under the proposed 7 kg per person formula, compared to the current 35 kg flat allocation. Bihar’s food security situation remains challenging: the State has high rates of malnutrition, and AAY coverage is critical for the State’s most vulnerable communities. The delayed Census means that Bihar’s growing population — which has crossed 13 crore — may not be fully reflected in current NFSA beneficiary lists, potentially excluding millions of eligible households. Bihar’s specific interest in NFSA reform thus differs from Southern States: Bihar would likely support the per-person approach while also demanding expansion of AAY coverage to include households excluded due to Census delays.

Way Forward

The NFSA amendment must balance equity, nutritional adequacy, and fiscal sustainability. First, the amendment should increase the per-person entitlement from the proposed 7 kg to at least 10 kg per person for AAY cardholders, to avoid reducing food access for smaller households. Second, the AAY beneficiary list must be comprehensively updated, using satellite-based poverty mapping and State-level socioeconomic surveys in the absence of a completed Census. Third, pulses and edible oil should be progressively incorporated into the food security basket, starting with a 1 kg pulse entitlement per AAY household per month — in line with ICMR recommendations. Fourth, State-level flexibility should be preserved, allowing States to supplement Central allocation with State-funded additions. Fifth, the amendment should be deferred until the 2021 Census data is available.
